El presente trabajo de investigación está dividido en dos partes. La Primera Parte analiza si la terminación del mandato del presidente Zelaya, el 28 de junio, estuvo o no de acuerdo a la Constitución y las leyes de Honduras. La conclusión general de esta parte es que tanto su “separación” a cargo del Congreso, como su expulsión a Costa Rica a cargo de las Fuerzas Armadas (FF. AA.) fueron inconstitucionales. La Primera Parte llega también a las siguientes conclusiones: (1) que la Corte Suprema de Justicia sí tiene la autoridad constitucional para juzgar al Presidente por cualquier delito, para suspenderlo de su cargo durante el juicio y para hacer efectiva su destitución como consecuencia de una sentencia condenatoria; (2) que, si el Ministerio Público y la Corte Suprema hubieran actuado conforme a la Constitución y las leyes, habría sido posible juzgar, suspender y destituir con éxito al presidente Zelaya por la comisión del delito de abuso de autoridad; (3) que, en vez de corregir las acciones inconstitucionales a cargo de las FF. AA. y el Congreso, la Corte Suprema optó por validarlas.
